Terms of Service

Please make sure to thoroughly read the following rules before making a purchase. If anything is unclear, please feel free to contact me on any of the social platforms available. By placing an order, it will be assumed that you have read through, and accept the terms of service as listed below. Breach of any rules could result in blacklisting.

Please note that I will not be taking any responsibility for anyone that breach the terms of service

 

 


General terms:

- Payments must be made in full in USD, upfront through Paypal. Exceptions made at my own discretion.   

- An invoice will be provided as soon as all details, quantity and any extras for a piece have been provided. Ball park price ranges aren't out of the norm, as pricing can change depending on the amount of extra detail, sketches, additional requests, etc. that needs to be added. An invoice is only valid for 7 days. If the invoice is not paid in full within that time period, an updated invoice will be forwarded.

 - Please note: I will not be willing to negotiate prices once all sketches and an invoice has already been forwarded

  - Overdue invoices have a 7 day timeframe to be settled.

  - If an invoice is not paid in full after the initial 7 days (at the latest 5 pm AEST on the 7th day), an additional 10 USD

    per sketch, per day will be added to your bill. Penalty fees will be added every day at 5 pm AEST. This is not

    negotiable. A final payment reminder will be given on day 6

  - In the event where an invoice is not paid in full within 14 days (after warnings have been received), I will auction off or

    sell the sketches done as a way to compensate for my time and resources. This is valid for all sketches that I complete -

    including original ideas, original characters (OC's), emotes done for a specific channel, animations, etc. 

    - After the above mentioned 14 days, you will also revoke any and all rights to use any of my sketches (including sketches

      I've done for you in the past), and you will be blacklisted

NO "creative interpretations" will be done. This means that I need basic guidelines of what you want (for scenes, characters, their poses, etc). I don't mind brainstorming some ideas before starting with a sketch, but I will not take the entire project into my own hands. This is because the ideas / sketches I come up with might not be to your taste and I might have to start over multiple times before finding something you like. 

- I have the right to decline any commission or request I do not wish to do, or that makes me feel uncomfortable in any way.

 

- You have 2 weeks to give ideas for all sketches you want once a payment is made. So please make sure you have your ideas ready when placing an order. 
 

- Tasteful nudes and pastel gore requests are acceptable 

- Please make sure to describe what you want in as much detail as possible. Picture references and colour pallets are encouraged, but not required, except if specified otherwise. Any picture references, even sketches you drew yourself, are acceptable, but I will never copy any sketch or design created by another artist. 

- Please make sure to place orders with deadlines far enough in advance. General turnaround time is given along with the price list under each category. It is important to note that "business day(s)" revere to a 5 day business week (Mondays to Fridays). Make sure to take this into account when you have a specific deadline

     - Based on the size of the sketch, rushed orders can be done. Rushed orders do however have a penalty fee to mark your

       order as high priority. No rushed orders will be done for sketches that need to be done by the next day. 

- I will not take any responsibility for financial loss, or any emotional / physical distress in any situation. 

Edits, Cancellations & Refunds:

- With busy schedules, I fully comprehend that not everyone can respond within a day, but I do ask for feedback within 5 business days. If no response has been given within that time frame, I will keep a fee for the work already done and you will be asked to give details for how you would like to receive a refund with the remaining funds. If you place an order again, and the same situation happens, you will be blacklisted. 

- In the case where an event comes up in your life, please notify me. You will be given the choice of a refund (refunded amount will depend on the work I've already completed), or I can place your order on hold for a maximum of 30 days. If you're still not in a state to work with me after the 30 day period, I will keep a fee for the work already done and you will receive a refund with the remaining funds.

VERY IMPORTANT NOTE: 

  If I ask for details for the refund (if you haven't mentioned it yourself) - specifically where you want the funds deposited back to (eg. back into your PayPal account) and by when - and you fail to respond within 3 calendar months, all funds will be kept and seen as an admin fee. I will not take responsibility for any financial loss or emotional distress this may cause you. 

- Full refunds can take up to 30 days, so please be patient with the refund process. 

- No refunds will be given on an already completed design.

- If you wish to cancel an order while the design is still in progress, I will keep a fee as compensation for my time and work done, where after you will receive the remaining funds.

- All edits and concerns must be addressed before the final piece is given to you. Otherwise edits on an already completed piece can be done, but it will be at an additional fee which will depend on how big the change or edit is. 

- No edits will be done on pieces that are a week or older. This is because files older than a week gets deleted as it starts to take up too much space. This means that if you want edits done on an older piece, it will be treated and charged as a new 

piece.

- Chargeback claims will always be disputed and legal action will be taken where necessary.

Copyright:

- I do not support NFTs and will not be creating designs for this purpose. On the same note, no one has permission to sell my art or any of my designs as a NFT.

- Important note for Twitch emotes: You may not edit or alter the emotes in order to make animated emotes. I do have animated emote packages, so make sure to have a look at those. The only exception to this is if you use the default Twitch animation feature to animate your emotes.
 

- All artwork is my property, and by making a purchase or receiving it as a gift (from me or anyone else), you get the rights to use it. If any of the Terms of Service gets breached, you will be revoking your right to use any and all of my sketches.

 

- All artwork is for personal use only, and may not be resold to make a profit. 

- Artwork is NOT intended for commercial use. There is a Commercial use tab specifically intended for designs for commercial use. Any other art used for commercial use will be seen as a breach of the Terms of Service.

- My art may be reposted, as long as credit is given. 

- Recolouring, editing, changing / copying my artwork in any way without my permission will not be tolerated.

- Images may be printed, but may only be for personal use. Printed images may not be resold for profit 

- I have the right to post any artwork for promotional reasons on social media or on my website, but I will not resell or distribute it to any other person(s), that did not make the original purchase, for an additional profit - except in the case where pieces have been made to sell in bulk. This will clearly be indicated on a piece, and confirmation will be done before a purchase is made.

Commercial use ToS:
 

- All Terms of Service still applies to commercial use designs. The only difference is that by purchasing a commercial use design, you also get a commercial use license - which means you can sell the design for a profit (without any of my watermarks or signature) on merchandise, as prints, stickers, etc. There is no limitations as to what products you want to use it for.

- There is no limit to how many designs you can sell, and there is also no limit to how long the commercial use license is valid for ; commercial purchased sketches are for you to do with as you wish, while keeping within all my Terms of Service as mentioned above.

- A commercial use license does not mean you can sell and claim the artwork as your own, and resell claiming you made the sketches yourself
